MASSCASH 40th BIRTHDAY COMPETITION 2024

Terms and Conditions

  1. The Promoter is Masscash (Pty) Ltd (“the Promoter”).
  2. The Masscash 40th BIRTHDAY Competition 2024 (“the Competition”) will commence on 23 May 2024 and will close on 3 July 2024 (“the Competition Period”). Any entries received after midnight on the last day will be invalid and will not be considered.
  3. The Competition is only open to the Promoter’s customers that hold who are registered on the Promoter’s Data Warehouse System, and whose credit accounts are current and in good standing at the date of draw (“the Participants”).
  4. Employees, directors, members, partners, agents or consultants of the Promoter or its subsidiaries, their immediate family members, life partners, business partners and associates and any person directly or indirectly affiliated with the Promoter or any person directly or indirectly involved with the devising, production, management or marketing of the Competition are not eligible to participate in this Competition.
  5. The Prize will only be awarded:

5.1.   to a Participant as stipulated in these rules;

5.2.   if it is not unlawful to supply the Prize to a person in terms of any legislation or public regulation and the Promoter reserves the right to require proof that it will not be unlawful to supply a Prize (for example to request the winner of a TV to provide his/her valid, fully-paid up TV license to the Promoter before they can hand over the prize).

  1. By entering the Competition, the Participants accept these terms and conditions (“the Rules”) and agree to abide by them. Any Participants may request to be furnished with a copy of the Rules at no cost by emailing such request to Matshediso. [email protected].

7.1.   The Participants agree and understand that they stand a chance to win 1 (One) of 34 (Thirty-Four) Suzuki Bakkies to the value of R190 000.00 (Hundred and Ninety Thousand Rand) each (VAT inclusive) (“the Prize/s”).

7.2.   In order to qualify to receive an automatic entry into the draw, Participants are required to spend R10 000.00 or more during the Competition Period at one of our thirty-two Masscash Main stores, on Kazang or Shop2Shop, enter the Competition via WhatsApp (to be provided) and follow the prompts (1 of the prompts is to upload their till slip as proof of purchase).

  1. The Promoter reserves the right to exchange the Prize for another Prize of equal or greater value, should the circumstances require this.
  2. Participants will receive an automatic entry when they spend R10 000.00 or more at a participating Masscash Cash and Carry Store, or on Kazang or Shop2Shop, during the Competition Period, retain their till slip, enter Competition via Whatsapp and follow the prompts ((1 of the prompt is to upload their till slip as proof of purchase).
  1. In order to gain entry to the Competition, the purchases must be captured on the Promoter’s Data Warehouse System.
  2. From the qualifying entries, there will be 34 (Thirty-Four) winners randomly drawn from all qualifying entries received, made up of 32 (Thirty-Two) winners from participating Masscash Cash and Carry Main Stores around the Republic of South Africa, 1 (One) winner from Kazang and 1 (One) winner from Shop2Shop.
  3. As a Participant you are eligible for unlimited entry and you are only eligible for 1 (One) Prize under this Competition.
  4. The winners of the Stock Vouchers shall be the 34 (Thirty-Four) qualifying entries randomly drawn by way of a draw which will be held, at the earliest on 5 July 2023, but no later than 3 (Three) months after the end date of the Competition. An independent person will monitor, verify and certify the draw and, except in so far as is provided for in the Consumer Protection Act 68 of 2008, his/her decision will be final and no correspondence will be entered into in this regard.
  5. It is your responsibility to ensure that of all information provided by or on behalf of you to the Promoters is accurate, complete and up-to-date at all times. The Promoters will notify the winners of the Prize by contacting the winners using the contact details supplied to the Promoters by or on behalf of the winners. The Promoters will attempt to contact the winners at least 3 (Three) times, but if the Promoter is unable to contact the winners within 3 (Three) working days, such winners will forfeit their Prize and the Promotor reserves the right to redraw such Prize and a second draw will be held where the procedure as set out above will be repeated.
  6. The winners, by furnishing the Promoter with the above-mentioned documents, consent to the Promoter utilising and processing his/her personal information strictly for the purposes of the Competition.
  7. There are certain situations in which a winner will forfeit his/her Prize, namely:

16.1     The winner has already won a Prize in this competition or in any competition in the previous 3 (Three) months;

16.2     The winner fails to provide participant information within 24 (Twenty-Four) hours of it being requested by the Promoter;

16.3     The winner fails to comply with any of these rules or the terms of acceptance of the Prizes and he/she is found to have contravened any other rule set out herein;

16.4     If the winner refuses to sign the Promoters’ winner’s declaration or the Promoters’ winner’s Prize acceptance form;

16.5     If the winner fails to accept delivery of the Prize after the Promoter has made at least 2 (Two) attempts to deliver it; and

16.6     If is unlawful for that winner to receive that Prize.

The above listed will be construed as a rejection of the Prize and then, without prejudice to any other remedy which the Promoters may have, the winner will be automatically disqualified and will forfeit the Prize.

  1. Participants enter the Competition entirely at their own risk. The Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, any participating Masscash Cash and Carry Liquor Store and/or its subsidiaries cannot be held responsible or liable for any accident, injury, harm or loss suffered by any person or entity as a direct or indirect result of entering the Competition or suffered as a direct or indirect result of the utilisation in any way whatsoever of the Prize won in terms of the Competition.
  2. Participants hereby agree to release and indemnify the Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors and subsidiaries and hold it harmless against any and all losses, harm, damages, rights, claims and actions of any kind in connection with the Competition, promotion or special offer or resulting from the participation in the Competition or acceptance, possession, use or receiving of any Prize relating to the Competition, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
  3. The Prize is not transferable and cannot be deferred or exchanged for cash. The Promoter will do the necessary to effect transfer of ownership of the Prize to the winners and the Promoter will pay all costs relating to transfer of ownership of the Prize from the Promoter to the winners. If for any reason, the Promoter cannot transfer ownership to the winners within 60 (Sixty) days from the date the winner’s entitlement to the Prize is confirmed in terms of paragraph 10, the winners shall forfeit the Prize and a second draw will be held in accordance with paragraph 14 above.
  4. The Prize does not include any other costs or expenses relating to the Prize or the enjoyment of the Prize not expressly specified in these Rules. All taxes, insurances, and/or other expenses resulting from or relating to the Prizes are the sole responsibility of the winners unless otherwise stated. From date of transfer of ownership any and all risk in the Prizes will pass to the winners and it will be the winner’s sole responsibility to take out the necessary insurance in respect of the Prize. Accordingly, the Promoters and their affiliates, will not be responsible for any other expenses which the winners may incur as a result of their acceptance and/ or use of a Prize, whether foreseen or not.
  5. All taxes, insurances, and/or other expenses resulting from or relating to the Prize are the sole responsibility of the winners unless otherwise stated. From date of transfer of ownership any and all risk in the Prize will pass to the winners and it will be the winner’s sole responsibility to take out the necessary insurance in respect of the Prize.
  6. The Prize must be collected from the relevant Masscash Cash and Carry Liquor Store where the winners entered within 14 (Fourteen) days of the winners being notified to collect the Prize. If the Prize is not collected within 14 (Fourteen) days of being notified, the winners will be disqualified and a further draw will be held where the procedure as set out above will be repeated.
  7. The winners will be required to sign an acknowledgement of receipt of Prize and may be requested to be photographed and identified in any media, which is inclusive of but not limited to television, radio, print publications and online sites in which the Competition receives exposure and for future marketing initiatives with the understanding that the winners may decline such an invitation.
  8. The Promoter reserves the right to amend the Competition Rules if such amendment is necessary from a practical or fairness point of view. The Promoter shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse against the Promoter, its agents and staff.
  9. The Promoter makes no warranties, express or implied, regarding the Competition or the Prize, including but not limited to the merchantability or fitness for a particular purpose. The Promoter does not guarantee the availability, quality, or safety of any products or services provided as part of the Prize, which are subject to the terms and conditions of the respective suppliers or providers.
  10. The Promoter shall not be responsible for any failure or delay in the performance of its obligations under the Competition, if such failure or delay is caused by acts of God, natural disasters, war, terrorism, strikes, lockouts, or any other events beyond our reasonable control.
  11. The Promoters reserve the right to extend the duration of the Competition period in the event that the Promoters have not received the minimum number of qualifying entries for the Competition period.
  12. The above Rules are severable. This means that if any one rule is found to be unlawful, it will be removed and the remaining Rules will still apply.
  13. Any violation or attempt to violate any of the above Rules will result in the immediate disqualification of the Participant.
